4. Placing Orders and Contract Information
4.1 Order Placement
For avoidance of doubt, the advertisements appearing on this site constitute an invitation to treat. If you wish to purchase goods from us you should order by adding the item to your cart and completing billing and shipping details as prompted at this site.
4.2 Order Confirmation
After placing an order, you will receive an email from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted or that we are guaranteeing supply. Your order constitutes an offer to us to buy a Product.
4.3 Contract Formation
All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an email that confirms that the product has been dispatched (Dispatch Confirmation). On placing your order payment may be automatically taken from you, however, this will not be processed until the contract is formed.
4.4 Contract Amendments
The contract is formed by sending (and not the receipt) of the dispatch confirmation, and these terms will not be affected by any typographical error on the part of the customer or the failure to provide a valid email address. If your order is not accepted we will cancel your order and refund any payment via the original payment method, or by cheque at our discretion.
4.5 Pricing
We reserve the right for some prices to differ from our in-store prices due to online promotions or postage and packaging costs.
5. Availability of Stock
5.1 Stock Availability
All orders are subject to product availability and limited stock. If the product you have ordered is not available from stock, you will be contacted by e-mail and will have the option to either wait until the item is available or to cancel your order.
5.2 Payment Verification
We will verify your payment information with your card issuer before your order is dispatched. Failure to provide correct billing information or correct card security information will delay your order. Please ensure the billing address provided is the address registered with your card issuer. The card security code from the back of your card is required with all orders; this is the group of three digits printed on the reverse of the card. All orders are subject to satisfactory security checking.
6. Website Prices and Payment
6.1 Pricing Details
All prices are inclusive of VAT at the current rate and are correct at the time of entering the relevant information. Prices are liable to change at any time, but changes will not affect orders in respect of those which have already been sent a Dispatch Confirmation.
6.2 Pricing Errors
Our site contains a large number of products, and it is always possible that, despite our best efforts, some of the products listed on our site may be incorrectly priced. If a product’s correct price is higher than the price stated on our site, we will normally, at our discretion, either contact you for instructions before dispatching the product or reject your order and notify you of such rejection.
7. Damages and Faults
7.1 Goods Inspection
Please check goods before signing for them and record on the carriers manifest if there is any damage. Failure to record any damage at the time of signing for it will result in subsequent claims for damaged goods being refused.
7.2 Proof of Delivery
Once signed, this is accepted as Proof of Delivery, confirming all goods have arrived safely with no damages. Claims of damage or pilferage must be notified in writing both in the courier’s manifest and to the company within 3 days of delivery. Claims cannot be accepted outside these time limits.
7.3 Packaging Retention
Packaging must be retained for investigation. Claims for non-delivery must be made within 7 days of receipt of dispatch confirmation.
7.4 Faulty Goods
Our policy is that faulty goods under a 1-year warranty must be returned to our store for evaluation with a valid proof of purchase. The cost of collection and delivery and also the cost of repairing goods which are found not to be covered under warranty must be paid by yourself.
8. Complaints Procedure
We handle all complaints fairly, effectively, and confidentially. We will make it our priority to deal with any complaints via email, telephone, or letter. That Pond Guy Ltd. is a family business and has very high standards and will do their best to maintain it.
